Navigating the Complexities of Wills for Second Families: The Power of Trusts



Second marriages and blended families often add a layer of complexity to estate planning. However, with careful planning and the use of Trusts, it's possible to ensure that your wishes are fulfilled and your assets are protected.

When spouses with children from previous marriages write a Will, a common concern is ensuring that their assets pass to their intended beneficiaries. Instead of the surviving spouse inheriting everything, which could unintentionally disinherit the deceased spouse's children, assets can be placed into a Trust.

In this scenario, assets such as half the house, cash, and investments (but not pensions as they fall outside of the estate - read more about this in my blog about pensions here can be transferred on death to a Trust. The beneficiaries can be the surviving spouse and their children. With the right trustees in place, your desires and wishes can be fulfilled.

Without a Will or with only basic mirror Wills in place, your assets are exposed to several risks. I have written about all the potential risks here.

However in terms of risks in this scenario a risk to consider is Marriage After Death (MAD): On the first death, all the assets are then solely owned by the surviving spouse. If the surviving spouse remarries, the inherited estate could be lost to the new spouse, disinheriting your children.

By using a Trust, you can mitigate these risks. Assets held in the Trust do not add to the beneficiaries' own estates and so cannot be assessed for their care costs, creditor claims, bankruptcy, or impact their own Inheritance Tax. Furthermore, assets in a Trust are protected from divorce settlements and cannot be lost in the event of the surviving spouse's remarriage.
